Terms of Service for SongHQ

Please read these Terms of Service carefully before using SongHQ. By creating an account or using our service, you agree to these terms.

1. What SongHQ Does

SongHQ is a production workspace for sellers who fulfill custom-song orders — collecting a customer's brief through an intake form, generating lyrics/song/cover art, getting customer approval through a review link, and delivering the finished product through a branded delivery page. SongHQ is a tool you use to run your own business; we are not a party to the sale between you and your customer, and we do not process payment on your customers' behalf.

2. Your Account

You need a seller account to use SongHQ. When you register, you agree to:

  • Provide accurate information
  • Keep your login credentials secure
  • Be responsible for all activity under your account, including orders created and content generated through it

3. Credits, Plans, and Billing

SongHQ subscriptions come in three tiers — Starter ($19/mo), Pro ($49/mo), and Studio ($99/mo) — each with a monthly credit allowance and limits on brands, templates, and features like CRM and white-label. Current pricing and limits are shown on the Pricing page and in Settings → Billing.

Monthly credits cover cover-art generation and any song generation run without a connected Suno account. Generating through your own connected Suno account (see Section 6) does not draw from your monthly credits. Unused monthly credits do not carry over to the next billing cycle unless otherwise stated on your plan.

Payments are processed by Creem. All charges are in USD. You may cancel your subscription at any time — your access continues until the end of the current billing period. We do not offer refunds for partially used billing periods except where required by law.

To change plans, use Request a plan change in Settings → Billing, or email support@songhq.app. Billing questions and refund requests should be sent to the same address; we aim to respond within 3 business days. If a refund is approved, it is returned through the original payment method by Creem.

Prices may change. We'll give you at least 30 days' notice before any price increase takes effect.

4. Your Content

You and your customers retain ownership of the information submitted through intake forms, review responses, and the lyrics, songs, cover art, and lyric cards generated for your orders. Using SongHQ does not transfer any rights in that content to us. We store and process it to run the service — nothing more.

We do not use your content, or your customers' content, to train AI models. We do not share it with third parties except as needed to run the service (see our Privacy Policy for details).

A note on commercial rights: song generation runs through Suno — either your own connected account (BYO) or, where applicable, a platform-provided path. Whether you can grant your customer full commercial rights to a generated song, and under what conditions, is governed by Suno's own terms of service for the account used to generate it, not by SongHQ. You are responsible for reviewing those terms and for what you represent to your customers about the rights they're getting. SongHQ makes no independent warranty about copyright, exclusivity, or commercial-use rights in generated output.

5. Your Customers' Data

You are responsible for having a lawful basis to collect the information you request through your intake forms, for how you use it, and for complying with any policies of the marketplaces you sell on (for example, Etsy or Fiverr rules around AI-generated content, AI-disclosure requirements, or off-platform contact). SongHQ processes this data on your behalf as the tool you've chosen for fulfillment; see our Privacy Policy for how we handle it.

6. Connecting Your Own Suno Account (BYO)

If you connect your own Suno account, you are responsible for that account: its terms of service, its usage limits, and any costs charged to it by Suno directly. We store your API key encrypted and use it only to make generation calls on your behalf when you trigger them. We are not responsible for Suno's service availability, pricing, or policy changes.

7. Acceptable Use

You may use SongHQ for any lawful purpose. You agree not to:

  • Submit or generate content you don't have the right to create or distribute
  • Use the service to produce illegal, infringing, or harmful content
  • Attempt to circumvent usage limits, payment requirements, or access controls
  • Reverse-engineer or scrape our platform
  • Resell or redistribute SongHQ as your own service without our written permission

We reserve the right to suspend accounts that violate these terms.

8. No Guarantees on Generation Results

AI song and lyric generation works well in many situations, but results depend on the underlying generation provider (Suno) and the quality of the brief submitted. We do not guarantee that every generation will meet a specific creative or quality standard, that it will succeed on the first attempt, or that generated content will be free of third-party rights claims.

9. Service Availability

We aim for high availability but cannot guarantee uninterrupted service. We may perform maintenance, updates, or experience outages, including outages caused by upstream providers like Suno, Creem, or our hosting infrastructure. We are not liable for losses resulting from service downtime.

10. Limitation of Liability

To the extent permitted by law, SongHQ's total liability for any claim arising from your use of the service is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including disputes between you and your customers.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we'll notify you by email or by posting a notice in the app. Continued use of SongHQ after changes take effect constitutes acceptance of the new terms.
